MATERIAL FACTRio de Janeiro, March 05, 2010, - BRASIL ECODIESEL INDÚSTRIA E COMÉRCIO DE BIOCOMBUSTÍVEIS E ÓLEOS VEGETAIS S.A., ("Company"), a publicly-held company with head offices at Praia de Botafogo, 501, Bloco II, Sala 701-B1, Centro Empresarial Mourisco, CEP 22250-040, in the city and state of Rio de Janeiro, whose common shares are listed on the Bovespa's Novo Mercado trading segment under the ticker ECOD3 ("Brasil Ecodiesel"), in accordance with Paragraph 4 of Article 157, of Law 6,404/76, as amended ("Brazilian Corporation Law"), and Item XXII of the Sole Paragraph of Article 2 of CVM Instruction 358/2002, hereby informs its shareholders and the market in general that:The Ministry of Agrarian Development published in the Official Federal Gazette, on this date, a decision referring to an administrative proceeding involving the company in relation to the compliance with the Social Fuel Seal for 2007.  According to this decision, the Seal was suspended for one year in the Iraquara, Itaqui, Cratéus and Floriano plants (the two latter plants are non-operational), which means these plants are no longer able to sell biodiesel through auctions organized by the Brazilian Oil Agency (ANP) for biodiesel holding the Seal (80% of the total volume).The company does not agree with this decision and is taking the necessary legal measures to protect its own and its shareholders' interests.                     BRASIL ECODIESEL INDÚSTRIA E COMÉRCIO DE BIOCOMBUSTÍVEIS EÓLEOS VEGETAIS S.ACharles Mann de ToledoInvestor Relations Officer  Contact:Renato ParentoniInvestor RelationsPhone.: +55 (21) 2546-5031Fax.: +55 (21) 2546-5040E-mail : : www.brasilecodiesel.com.br/ir
